Terms & Conditions
Effective Date: October 24, 2026
Legal Document · 2026-10-24.1
1. Agreement and Service Operator
These Terms & Conditions govern your account and use of the A Trade For You website and app. “We,” “us” and “our” refer to the operator of A Trade For You; “you” refers to the member. Selecting the agreement checkbox and submitting registration signifies your agreement to this version. Read and save a copy before agreeing. Contact the operator at support@atradeforyou.com for legal or service inquiries.
2. Eligibility and Account Security
You must be at least 18 and legally able to enter contracts. Register with accurate information, maintain current contact details, and complete required verification before restricted actions. Do not impersonate anyone, share accounts, evade restrictions or access another person’s account. Protect your password and verification codes and promptly report suspected compromise. Verification confirms contact access, not identity, ownership, trustworthiness or item quality. You are responsible for activity you authorize; responsibility for unauthorized activity is determined by applicable law and the facts.
3. Our Marketplace Role
We provide tools for independent members to list, discover, negotiate and arrange exchanges. Unless expressly identified as the seller of a particular item, we do not own, inspect, authenticate, manufacture, store, transport or warrant members’ goods and are not a party to their item agreements. We are not an insurer, escrow service, appraiser, lawyer or tax adviser. Suggestions, badges, reviews and estimated values are informational, not endorsements or guarantees. Members must independently assess counterparties and terms.
4. Listings, Ownership and Disclosure
List only goods you own or are authorized to transfer. Use accurate current photos, descriptions, condition, location, availability and prices; disclose defects, damage, repairs, missing parts, liens, restrictions, recalls and safety concerns. Do not hide material facts or use misleading stock photos. Sellers must have necessary permits and transferable title and comply with product-safety and consumer laws. Vehicle transactions require the parties to verify title, VIN, liens, inspections, registration and required transfer documents. Remove unavailable listings promptly.
5. Prohibited Goods and Misuse
Do not list stolen, counterfeit, unlawfully recalled, illegal or infringing goods; weapons, ammunition, controlled drugs, prescription medicines, tobacco or vaping products; hazardous materials, human remains, sexual exploitation content, personal data, financial accounts or unlawful services. Do not list regulated goods the service cannot lawfully support. Fraud, money laundering, sanctions evasion, bots, scraping personal data, malware, hacking, spam, harassment, threats, discrimination and deceptive reviews are prohibited. Category availability is not permission to sell an otherwise prohibited item.
6. Prices, Offers and Negotiation Deadlines
Displayed monetary amounts are in US dollars unless explicitly stated otherwise. An offer may propose items, cash, or both. Review the complete proposal, participants, item descriptions, extra cash, payer, recipient and delivery plan before responding. In ordinary two-party negotiations each party may submit two counteroffers. An unanswered offer or counteroffer expires after 24 hours; the applicable negotiation then has an additional 24-hour waiting period before a new offer. The current server status and deadline control; notifications may be delayed.
7. Listing Changes and Binding Terms
A changed listing does not silently replace the item terms already reviewed in an offer. Review the proposal snapshot and any change notice. A material change to an item, participant, cash amount or delivery obligation requires renewed agreement by every affected party. Do not substitute goods or change a price after acceptance without consent. Acceptance records agreement to the displayed proposal; it does not prove payment, shipment, receipt, legal title transfer or successful completion.
8. Three-Person Trades
Each of the three participants must review the same current proposal, including all selected item photos and descriptions, who receives each item, each cash payment, and each person’s total cash payable and receivable. All three must expressly agree to that proposal before finalization. One person cannot consent for another. A revised proposal requires fresh consent. A matching suggestion or selected third-party listing does not grant permission to transfer someone else’s property. Failure of one leg can affect the whole exchange; agree on a contingency plan.
9. Free Membership and Future Charges
Registration is required to post and make offers, even during the free launch. Membership and listings are currently free; no subscription or payment method is required to use these free features. There is no automatic conversion to paid membership and no first-1,000-member promotion. Future paid membership requires notice, disclosure and explicit enrollment. Any future transaction, processing, payout, shipping or tax charges must be disclosed before commitment. These terms do not authorize a charge to your card or bank account.
10. Payments, Release Timing and Providers
Real payments are disabled. Cash fields, Buy It Now buttons, fee previews and test transactions do not mean that real funds were charged, reserved, held or paid. Do not treat a test confirmation as proof of payment. No escrow, buyer-protection fund, guaranteed refund or bank-arrival deadline is promised. Before real payments launch, separate provider terms, verified onboarding, applicable fees, refund rules, release conditions and bank timing will be disclosed. Provider processing does not automatically eliminate obligations imposed on the marketplace by law.
11. Taxes and Regulatory Duties
Each participant must comply with applicable tax, licensing, registration, export, import and customs rules. Cash sales and item-for-item barter can have tax consequences even with free membership. Any tax legally collectible from a buyer must be disclosed in the applicable checkout; sellers remain responsible for their own income and business reporting as required by law. We will comply with any marketplace collection or reporting obligations that apply to us. Neither these terms nor a payment provider transfers statutory tax obligations away from the legally responsible person.
12. Inspection, Delivery and Personal Safety
Before accepting, agree on pickup or shipping, deadlines, packing, carrier, tracking, insurance, costs, inspection, returns and what happens if an item is lost, damaged, delayed or different from its description. Inspect goods and verify ownership before confirming receipt. Meet in a safe public place and avoid sharing unnecessary personal information. Do not mark a transaction completed before the agreed obligations are met. We do not supervise meetings or control carriers, weather or other members and do not guarantee delivery or personal safety.
13. Returns, Cancellations and Disputes
Agree on return eligibility, inspection periods, return shipping, cancellations and refunds before committing. A seller’s “as is” or “no returns” statement cannot override mandatory law or excuse fraud or misdescription. Report problems promptly with the proposal, messages, photos and delivery evidence; preserve records. We may facilitate communication or review reports but do not guarantee resolution, compensation or recovery. Do not falsely confirm completion or submit fabricated evidence. Statutory claims, payment-provider rights and lawful reporting to authorities remain available.
14. Messages, Reviews and Moderation
Use messages for legitimate trading and communicate respectfully. Do not post outside contact details where messaging rules prohibit them or attempt to bypass safeguards. A first detected outside-contact violation receives a warning; a second can cause a 48-hour suspension. Threats, fraud or serious safety violations can justify immediate restrictions. Reviews must reflect genuine experience without extortion, incentives concealed from readers or manipulation. We may review relevant content, remove violations and restrict access. Automated checks can make mistakes; contact support to request review.
15. Your Content and Intellectual Property
You retain ownership of content you upload and must have permission to use it. You grant us a nonexclusive, royalty-free license to host, reproduce, resize, display and distribute it as needed to operate, secure and present your listings and service communications. This is not a sale of your rights. The license ends when content is removed from active service, except necessary backups, accepted transaction evidence and legally retained records. Do not copy our software or branding without permission. Send specific infringement reports with supporting information to support.
16. Privacy, Electronic Records and SMS
The Privacy Policy explains personal-data use, service providers, retention and your choices. Do not publish another person’s private data without authorization. We record the accepted terms version, language, server timestamp and document fingerprint with your member identifier. You may print or save these terms. Service records and notices may be electronic where lawful. Accepting these terms does not consent to SMS or marketing. Verification texts require separate consent and a user request; message/data rates may apply, codes expire after 10 minutes, and STOP/HELP options apply as described on the SMS consent page.
17. Deactivation, Deletion and Record Retention
Account Settings provides temporary deactivation and deletion. You may cancel a deletion request within 72 hours. After that, self-service cancellation closes; unresolved billing, transactions, disputes or legal duties may delay processing. Eligible accounts enter a restricted 30-day recovery archive, restorable only by the Site Owner or authorized support. After archive expiry personal profile data is erased under the Privacy Policy; limited transaction, dispute, security, consent and audit records may remain for lawful purposes. Deletion does not cancel existing obligations or another person’s evidence rights.
18. Service Availability and Third Parties
We may maintain, correct, change or discontinue features, and cannot promise uninterrupted, error-free or secure operation. Outages, bugs, inaccurate suggestions, translation errors, lost messages, delayed notifications and stale listings can occur. Keep your own copies of important records and verify material terms with the parties. External links, app stores, carriers and payment providers operate independently under their own terms. We do not control their services, endorsements, decisions or availability. Nothing here permits us to retain payments unlawfully or disregard mandatory notice or refund duties.
19. No Marketplace Warranty
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT GUARANTEE A MEMBER’S HONESTY, ABILITY TO PERFORM, ITEM AUTHENTICITY, CONDITION, LEGALITY, VALUE OR SUITABILITY, OR A SUCCESSFUL TRADE. THESE DISCLAIMERS DO NOT OVERRIDE AN EXPRESS PROMISE WE MAKE, MANDATORY CONSUMER GUARANTEES, OR LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED. A MEMBER’S OWN LEGAL OBLIGATIONS REMAIN THEIR RESPONSIBILITY.
20. Limits on Responsibility and Damages
To the extent permitted by law, we are not responsible for losses caused by members’ misrepresentations, defective or stolen goods, broken promises, unsafe meetings, shipping failures, unauthorized off-platform arrangements or third-party acts outside our reasonable control. We exclude indirect, incidental, special, consequential and punitive damages, including lost profits or opportunities, to the extent legally permissible. These limits do not exclude liability for our fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence where exclusion is prohibited, or other non-waivable duties. They do not excuse our own unlawful conduct or eliminate mandatory remedies. Some jurisdictions do not allow these exclusions, so they apply only as permitted there.
21. Claims Arising from Your Conduct
To the extent permitted by law, you are responsible for third-party claims and reasonable, documented losses and legal costs caused by your unlawful listing, infringement, fraud or material breach of these terms. This does not require you to indemnify us for our own misconduct or obligations the law assigns to us. We will provide reasonable notice and an opportunity to participate in the defense where practicable. No settlement may impose an admission or nonmonetary obligation on you without your consent. Mandatory consumer protections prevail.
22. Restrictions, Appeals and Termination
We may restrict listings, messages, offers or accounts to investigate credible fraud, safety risks, abuse, legal demands or material violations. Where lawful and practicable, we will explain the reason and allow a support review; urgent safety or legal needs may require action first. Contact support if a restriction is mistaken. Closing an account does not erase an accepted transaction or lawful claim. Rules concerning existing obligations, records, intellectual property and permitted limits on liability continue where relevant after access ends.
23. Governing Law, Changes and Interpretation
Florida law governs to the extent consistent with mandatory laws and consumer protections applicable to you. These terms impose no mandatory arbitration, class-action waiver or waiver of access to regulators or courts with lawful jurisdiction. If a clause is unenforceable, the rest remains effective to the extent lawful. These terms and expressly incorporated policies govern service use; they do not replace the parties’ specific item agreement. We will identify updated versions and give notice of material changes and request renewed agreement where required; changes do not retroactively authorize charges or rewrite accepted trades. Translations are provided in the selected language; report unclear wording rather than assuming it waives a legal right.
24. Contact, Reports and Related Policies
For account help, complaints, appeals, privacy requests or legal notices, contact support@atradeforyou.com or 1-833-962-0870. Support hours are Monday–Friday, 9:00 AM–5:00 PM Eastern Time; this is not an emergency service and response times are not guaranteed. For immediate danger contact local emergency services. Include your username and relevant listing or offer identifier, but never send passwords, verification codes or full card details. Read the linked Privacy Policy, Community Rules, Trading Safety guidance and SMS consent information alongside these terms.
